Boswell Enterprises LLC wholly owns and operates this website and all services provided. We provide done-for-you digital marketing services, custom websites, sales funnels, and AI-powered business tools.
For clarity, our offerings are divided into two categories:
Products: Digital products, training programs, courses, templates, eBooks, audiobooks, GPT tools, pre-recorded content, and downloadable materials.
Services: One-on-one coaching, group coaching, consulting sessions, done-for-you implementations, custom website builds, sales funnel development, marketing retainers, email campaign creation, social media management, reputation management setup, and any custom development or strategic work performed specifically for you.
Key Terms
Scope: We provide professional services (coaching, consulting, and done-for-you work) and digital products (courses, templates, and training materials) to support your business growth. Results may vary based on your effort and implementation, and no specific results are guaranteed.
Service Term: Ongoing services (website packages, marketing retainers) are provided month-to-month with no long-term commitment unless otherwise specified in your purchase. Consulting engagements may include specific term lengths as agreed upon at time of purchase. One-time services (website builds, funnel development) are delivered as specified with no ongoing term.
Auto-Renewal: Your subscription will automatically renew each billing cycle and your payment method will be charged unless you cancel prior to the renewal date.
Immediate Service Commencement: Upon payment confirmation, we immediately begin provisioning your website and services. This immediate delivery is why service refunds cannot be issued once payment is processed.
Client Responsibilities: You agree to provide necessary access to your data and materials for us to perform our services. It is your responsibility to implement our strategies and follow through with provided guidance.
Payment: Payment is required in full before services begin or before product access is granted. You agree to keep valid payment information on file for any recurring charges. Late payments may be subject to late fees and service suspension. Continued non-payment may result in termination and collections.
Third-Party Software: Our services may require third-party software subscriptions (such as HighLevel and Search Atlas) which are billed separately by those providers. These subscriptions are your responsibility and not included in our service fees.
Legitimate Transaction Acknowledgment: By completing your purchase, you acknowledge and confirm that this is a legitimate, authorized transaction made by you. You agree that if you have any concerns about your purchase, you will contact us directly at [email protected] before initiating any dispute with your bank or credit card company.
Cancellation: You may cancel your service at any time. Cancellations are effective at the end of your current billing period. You will retain access to services through the end of your paid period, but no refunds will be issued for the current billing cycle.
Termination & Asset Ownership: Upon cancellation, we will cease all active management and updates to your website. You retain ownership of all website assets and content delivered prior to cancellation, but ongoing services (updates, support, SEO management) will cease immediately at the end of your billing period. Any outstanding fees must be settled before final delivery of assets.
Service Suspension for Non-Payment: Services may be paused if payment is not received within 30 days of the due date. Access will be restored upon payment of all outstanding fees plus any applicable late fees.
We offer two types of purchases with different refund policies:
Services - ALL SALES FINAL (No Refunds)
All service purchases are completely final and non-refundable once payment is processed. There are no refunds, credits, or chargebacks accepted for services under any circumstances. This strict no-refund policy applies to:
One-on-one coaching or group coaching programs
Consulting sessions or consulting packages
Done-for-you custom website builds
Done-for-you sales funnel development
Marketing retainers or ongoing service packages
Email campaign creation
Social media content packages
Reputation management setup
Any custom development, implementation, or strategic work
Why Services Have No Refunds: When you purchase a service, you are paying for our time, expertise, and custom work. This value is delivered immediately and cannot be returned. Once payment is processed, your investment is final and non-refundable. Services are considered to have commenced immediately upon payment, as we reserve time and resources for your project. By purchasing any service, you explicitly acknowledge and agree to this no-refund policy.
Products - 30-Day Money-Back Guarantee
Digital products, training programs, and informational courses come with a 30-day satisfaction guarantee. This applies to:
Digital courses and training programs
eBooks and audiobooks
Templates and downloadable resources
GPT or AI tools
Pre-recorded content and materials
Any informational products not requiring custom work
To request a refund on a digital product, contact us at [email protected] within 30 days of purchase. You must provide proof that you made a good-faith effort to implement the material (such as screenshots of completed exercises, examples of your work, or evidence of attempted implementation). Refund requests without evidence of implementation may be denied.
No Results Guarantees
While we have a history of successful client outcomes, we do not guarantee specific financial results, revenue increases, lead generation numbers, or performance metrics. Your success depends on many factors including your market, offer, implementation, effort, and circumstances unique to your business. We provide tools, training, systems, and services—your results depend entirely on how you use them.
Unauthorized Chargeback Policy
By completing a purchase with us, you certify that:
You are the authorized cardholder or have permission to use the payment method
This is a legitimate transaction that you intentionally authorized
You understand and agree to our refund policies as stated above
You will contact us directly to resolve any concerns before disputing charges with your bank
If you are dissatisfied with a purchase, you must contact us first at [email protected]. We are committed to resolving issues fairly and will work with you in good faith.
Filing a chargeback or payment dispute for a legitimate purchase that does not meet the criteria for a refund under our policies may be considered fraudulent and will result in:
Immediate termination of all services and access to products
Collection efforts for the disputed amount plus chargeback fees (typically $15-25 per dispute)
Reporting to credit agencies and fraud prevention services
Potential legal action to recover fees and costs
Exception: Chargebacks filed for genuinely unauthorized transactions (fraud, stolen card) are always acceptable and will not result in penalties.
Proper Refund Process: If your purchase qualifies for a refund under our 30-day product guarantee, simply contact us and we will process it promptly. Filing a chargeback for refund-eligible products instead of contacting us directly may result in processing delays and fees.
Transaction Records: We maintain detailed records of all transactions including order confirmations, timestamps, IP addresses, and acceptance of these terms. These records may be used as evidence in the event of disputes or legal proceedings.
Ownership: Unless otherwise stated, Boswell Enterprises LLC owns all intellectual property rights for content and software provided through our services. You may not reproduce, copy, or redistribute materials without our express written consent.
Client Data: You retain ownership of all data you provide, and we will use it only to deliver our services to you. We may analyze anonymized data to improve our offerings.
Limitation of Liability: We are not liable for any direct, indirect, or consequential damages arising from your use of our website, software, or services. Our total liability is limited to the amount paid by you for services during the previous three months.
Indemnification: You agree to indemnify and hold us harmless from any claims or damages resulting from your use of our software or services, including third-party claims related to data privacy or intellectual property.
Cookies: Our website uses cookies to enhance user experience and analyze site traffic. By using our website, you consent to the use of cookies.
Data Security: We implement reasonable security measures to protect your data. However, we cannot guarantee complete security against all threats. Your use of the website and software is at your own risk.
Non-Disclosure: Both parties agree to keep confidential any proprietary information shared during the term of this agreement. This obligation extends beyond the term of this agreement for a period of two years.
Portfolio Use: You permit us to use your company name, logo, and general project details for marketing purposes, including on our website and promotional materials.
These terms are governed by the laws of the State of Utah, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Utah.
